Summary

These terms cover the use of this website. They are not the agreement under which we bill for a practice: that is a separate signed services agreement, together with a business associate agreement.

The short version: the site is information and tools, the calculator is an estimate rather than a quotation, nothing here is professional advice, and nothing here creates a client relationship on its own.

Accepting these terms

By using this website you agree to these terms. If you do not agree to them, please do not use the site. If you use the site on behalf of an organisation, you confirm you are authorised to accept these terms for it.

What this website is

This site describes the services iFocus RCM Solutions LLC offers, the specialties and states we work in, and provides tools such as the revenue calculator. It is marketing and reference material.

Submitting a form does not create a contract, a client relationship or a business associate relationship. Those begin only when a written agreement is signed by both parties.

The calculator is an estimate, not a quotation

The revenue calculator applies stated assumptions to numbers you enter. Those assumptions are published on the calculator page so you can check them. The result is an illustration of what a change might be worth, not a quotation, a projection, a guarantee or a promise of any particular outcome.

Your actual results depend on your payer mix, your documentation, the age and composition of your accounts receivable and factors outside anyone’s control. Do not make a financial decision on the calculator alone.

Figures and claims on this site

Performance figures shown on this site describe our own operational measurements or, where stated, client supplied information. They describe past or typical performance and are not a guarantee of the results any particular practice will see.

Where a figure is a target or a benchmark rather than a measured result, the page says so. If you are relying on a specific number in making a decision, ask us for the definition and the method behind it and we will give you both in writing.

No professional advice

Nothing on this site is legal, medical, coding, compliance, tax or financial advice, and it is not a substitute for advice from a qualified professional who knows your circumstances. Coding and payer rules change; content here may not reflect the current position on the day you read it.

Do not send patient information through this site

The forms on this website are not a secure channel for protected health information. Do not submit patient names, records, claim files or any PHI through them. If you need to send claims data, contact us and we will arrange a secure route under a signed business associate agreement.

Acceptable use

You agree not to:

• use the site in any way that breaks the law or infringes anyone’s rights;
• submit false information, or another person’s information without their permission;
• attempt to gain unauthorised access to the site, its accounts or its underlying systems;
• probe, scan or test the vulnerability of the site, or defeat its security or rate limits;
• scrape, harvest or bulk copy content from the site by automated means;
• use the site to send unsolicited commercial messages.

Intellectual property

The content, design, graphics, text and code of this site belong to iFocus RCM Solutions LLC or to its licensors, and are protected by copyright and other laws. You may read, print and share pages for your own business use. You may not republish, sell or redistribute the content, or create derivative works from it, without our written permission.

Our name and logo are our trademarks. You may not use them without permission except to refer to us fairly.

Third party names and links

Names of insurers, clearinghouses, practice management systems, electronic health record systems and other organisations may appear on this site to describe the systems we work in and the payers we submit to. Those names are the trademarks of their owners. Their appearance does not mean we are endorsed by, affiliated with, partnered with or contracted with them.

Where the site links to another website, we do not control it and are not responsible for its content or its privacy practices.

Availability and changes

We may change, suspend or withdraw any part of this site, including content and tools, without notice. We do not promise the site will be uninterrupted or error free, and we may carry out maintenance at any time.

We may update these terms. The date at the top of the page shows when they last changed, and continuing to use the site after a change means you accept the updated terms.

Disclaimer of warranties

The site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non infringement, and any warranty that the content is accurate, complete or current.

Limitation of liability

To the fullest extent permitted by law, iFocus RCM Solutions LLC, its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or connected with your use of this website, whether based in contract, tort, statute or otherwise, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims connected with this website will not exceed one hundred US dollars (US$100). Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

This section limits liability for the website. Liability under a signed services agreement is governed by that agreement, not by this page.

Indemnity

You agree to indemnify and hold iFocus RCM Solutions LLC harmless from claims, losses and reasonable legal costs arising from your misuse of this site, your breach of these terms, or your violation of any law or third party right.

Governing law and where disputes are heard

These terms, and any dispute arising out of them or out of your use of this website, are governed by the laws of the State of Texas, without regard to its conflict of law rules.

You and iFocus RCM Solutions LLC agree that the state and federal courts located in Harris County, Texas have exclusive jurisdiction over any such dispute, and each of us submits to the personal jurisdiction of those courts.

Before starting proceedings, please contact us at info@ifocusrcm.com so we can try to resolve the matter directly.

If part of these terms cannot be enforced

If any provision of these terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in force. A delay in enforcing a term is not a waiver of it.

These terms, together with the privacy policy and any notices on this site, are the entire agreement between you and us about the use of this website.
